What the Time Warner v. Town of Landis Ruling
Means for Public Power Utilities in North Carolina
The recent North Carolina business court ruling in the case of the Town of Landis v. Time Warner Cable has caused some public power utilities to sit up and take notice. While some have taken great issue with this decision, others have considered revisiting legislative battles of the past. A closer reading of the court’s decision makes it clear that utilities need to recover revenue within the framework of their existing agreements and work in a more orderly, consistent way with their attachers to recover that revenue. It is time for the utilities to “get back to the basics” of their agreement.
